These Terms and Conditions (“Terms”) govern your access to and use of the Local Guide App, including the websites localguide.destinationhub.co.uk, folkestone.destinationhub.co.uk, and any Local Guide pages, features, tools or services operated by Destination Hub Limited (together, the “Local Guide” or “Service”).
Please read these Terms carefully before using the Service. By accessing or using the Local Guide, you agree to these Terms. If you do not agree with them, you should not use the Service.

In these Terms, “Destination Hub”, “we”, “us” and “our” refer to Destination Hub Limited.
“You” and “your” refer to any person accessing or using the Service.
2. About the Local Guide
The Local Guide is an online information and discovery service designed to help users find local, travel and visitor-related information, products, services and experiences.
Depending on the destination and availability, the Local Guide may provide or display information relating to matters such as:
local attractions and things to see;
restaurants, cafés and places to eat;
events;
activities and experiences;
transport;
car rental;
travel eSIMs and connectivity services;
flights and other travel services;
flight compensation or passenger-rights services;
discounts and offers;
local businesses;
maps, directions and nearby places; and
other travel, tourism and destination-related products or services.
Features may vary between destinations and may be changed, added or removed at any time.
Unless expressly stated otherwise, the Local Guide is an information, discovery, comparison and referral service. We do not necessarily own, operate or provide the businesses, attractions, events, transport, accommodation, experiences, claims services or other third-party products and services displayed through the Local Guide.
3. Third-Party Providers
Some products, services, listings and offers displayed through the Local Guide are provided by independent third parties (“Third-Party Providers”).
These may include airlines, travel agents, booking platforms, car rental companies, transport operators, telecommunications providers, restaurants, attractions, tour operators, event organisers, claims companies and other businesses.
When you select a third-party product or service, you may be redirected to a Third-Party Provider's website, application or booking platform.
Unless we expressly tell you otherwise, any booking, purchase, reservation, claim, application or other transaction you make with a Third-Party Provider is entered into between you and that Third-Party Provider.
Destination Hub is not a party to that contract merely because you discovered the provider or accessed its service through the Local Guide.
The Third-Party Provider's own terms and conditions, privacy policy, cancellation policy, refund policy and other rules may apply to your transaction.
You should read those terms before completing a transaction.
4. Affiliate Relationships and Commission
The Local Guide may contain affiliate links, referral links, sponsored placements, advertising and other commercial partnerships.
If you click a link, make a booking, purchase a product, submit a claim or complete another qualifying action with one of our partners, Destination Hub may receive a commission, referral fee or other commercial benefit.
This will not necessarily result in an additional charge to you.
Where appropriate, we aim to make the commercial or affiliate nature of content clear.
The existence of an affiliate relationship does not mean that Destination Hub guarantees, endorses or assumes responsibility for the relevant Third-Party Provider or its products or services.
Commercial relationships may influence which providers or offers are available through particular sections of the Service. The Local Guide should therefore not be assumed to represent every provider or every option available in the market.
5. Flight Compensation and Claims Services
The Local Guide may provide access to services that help passengers investigate or pursue compensation or other claims relating to delayed, cancelled or disrupted flights.
Unless expressly stated otherwise, these services are provided by independent Third-Party Providers and not by Destination Hub.
If you choose to proceed, you may be redirected to a partner's website to check eligibility, provide information, submit a claim or complete the claims process.
The relevant partner may charge fees or retain a proportion of compensation recovered. You should review the partner's terms and fee structure before instructing them.
Destination Hub does not guarantee:
that you are eligible for compensation;
that a claim will be accepted;
that compensation will be recovered;
the amount of any compensation;
how long a claim will take; or
the outcome of any dispute with an airline or other party.
Information provided through the Local Guide concerning passenger rights or compensation is general information and should not be treated as legal advice.
6. Bookings, Reservations and Purchases
Certain Local Guide features may allow you to search for, compare or access booking and purchasing opportunities.
Where the booking or purchase is completed with a Third-Party Provider, that provider is responsible for processing and fulfilling the transaction.
Before completing a transaction, you are responsible for checking all relevant information, including:
dates and times;
passenger or customer details;
prices and currencies;
taxes and fees;
availability;
cancellation and amendment conditions;
baggage restrictions;
age or eligibility restrictions;
accessibility requirements;
insurance requirements;
identification, passport or visa requirements where relevant; and
any other provider-specific conditions.
Questions concerning an existing third-party booking, cancellation, refund or service should normally be directed to the provider with whom the transaction was made.
7. Prices, Offers and Availability
Prices, discounts, availability and offers displayed through the Local Guide may originate from Third-Party Providers.
Although we aim to present useful and accurate information, prices and availability can change rapidly.
A price shown in the Local Guide is therefore not guaranteed until confirmed by the relevant provider during the booking or checkout process.
Additional taxes, booking charges, service fees, local charges, currency conversion charges or other costs may apply.
Promotions and discounts may be subject to eligibility criteria, exclusions, availability and expiry dates.
If information displayed by the Local Guide differs from the final information presented by the Third-Party Provider, you should carefully review the provider's information before proceeding.
8. Local Listings and Recommendations
The Local Guide may contain information about restaurants, attractions, businesses, events and other places or activities.
Listings, rankings, recommendations, descriptions or categories are provided for general information and discovery purposes.
Inclusion in the Local Guide does not necessarily constitute an endorsement or guarantee by Destination Hub.
You should independently check information that is important to your plans before travelling or making a purchase.
In particular, opening hours, menus, prices, accessibility, availability, event times, age restrictions, admission requirements and other details can change without notice.
9. Maps, Location and “Near Me” Features
The Service may use location information or third-party mapping services to provide maps, directions, distances and nearby recommendations.
Location, mapping and distance information is approximate and may occasionally be inaccurate or unavailable.
You should not rely solely on the Local Guide for navigation where doing so could create a safety risk.
Your use of third-party mapping services may also be subject to the terms and privacy policies of the relevant mapping provider.
Where your device requests permission to access your location, you may control that permission through your device or browser settings.
10. Events
Information concerning events may be obtained from event organisers, venues, partners, public sources or other third parties.
Events may be postponed, cancelled, relocated, sold out or otherwise changed without notice.
You should confirm important event details with the organiser, venue or ticket provider before travelling or incurring costs.
Destination Hub is not responsible for an event organiser's decision to cancel, postpone or alter an event.
11. Travel Information
Travel-related information available through the Local Guide is intended for general informational purposes.
Travel conditions, entry requirements, timetables, transport services, local rules and other circumstances can change.
You remain responsible for checking official and up-to-date information relevant to your journey, including passport, visa, immigration, health, safety and entry requirements where applicable.
Nothing in the Local Guide constitutes immigration, legal, medical or other professional advice.
12. Accuracy of Information
We aim to keep the Local Guide useful and reasonably accurate. However, much of the information displayed through the Service is supplied, generated or maintained by third parties.
We therefore cannot guarantee that all content is complete, accurate, current or error-free at all times.

13. External Websites and Services
The Local Guide contains links to websites and services operated by third parties.
We do not control those external websites and are not responsible for their content, security, availability, privacy practices or operation.
A link does not, by itself, constitute an endorsement.
Once you leave a Destination Hub-operated service, you should review the terms and privacy policy of the website or service you are visiting.
14. Your Responsibilities
You agree to use the Local Guide lawfully and responsibly.
You must not:
use the Service for unlawful, fraudulent or abusive purposes;
attempt to gain unauthorised access to the Service or its underlying systems;
introduce viruses, malware or other harmful material;
interfere with or disrupt the operation or security of the Service;
scrape, crawl, extract or systematically reproduce content except where permitted by law or with our written permission;
use automated systems in a way that places an unreasonable burden on the Service;
impersonate another person or misrepresent your identity;
use the Service to infringe another person's intellectual property, privacy or other legal rights; or
reproduce, resell or commercially exploit the Service without our permission.
We may restrict or block access where we reasonably believe these Terms have been breached or where necessary to protect the Service, our users or third parties.
15. Intellectual Property
Unless otherwise stated, the Local Guide and the content created by Destination Hub, including its branding, design, software, text, graphics and other materials, are owned by or licensed to Destination Hub Limited and are protected by applicable intellectual property laws.
Third-party names, logos, trademarks, photographs and content remain the property of their respective owners.
You may use the Local Guide for your personal, non-commercial use.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
16. Availability of the Service
We aim to keep the Local Guide available, but we do not guarantee uninterrupted or error-free access.
We may temporarily suspend, restrict, modify or withdraw all or part of the Service for maintenance, security, technical, operational, commercial or legal reasons.
We may also add, remove or change destinations, features, integrations, providers and content.
Where reasonably practicable, we will seek to minimise disruption.
17. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, you have legal rights under applicable consumer protection law. Nothing in these Terms affects your statutory rights.
Subject to those protections, Destination Hub is not responsible for the acts, omissions, products or services of independent Third-Party Providers.
Where your contract for a product or service is with a Third-Party Provider, responsibility for performing that contract rests with that provider in accordance with its terms and applicable law.
To the extent permitted by law, we are not responsible for losses arising solely from:
inaccurate or outdated information supplied by a third party;
a Third-Party Provider changing or withdrawing a product or service;
cancellation or alteration of an event by its organiser;
the acts or omissions of independent travel, transport, hospitality, claims or other service providers; or
your failure to check material booking, travel or provider information before proceeding.
If you use the Local Guide for business purposes, we will not be liable for loss of profits, sales, business, revenue, anticipated savings, business opportunity, goodwill or reputation, or for indirect or consequential business losses, to the extent permitted by law.
Nothing in this section is intended to exclude responsibility that applicable law requires us to accept.
18. Consumer Rights
If you are using the Local Guide as a consumer, you may have rights under UK consumer law that cannot be excluded by contract.
These Terms are not intended to restrict those rights.
Different rights may apply depending on whether you purchase a service directly from Destination Hub or enter into a contract with a Third-Party Provider.
Where a Third-Party Provider supplies the relevant product or service, you should contact that provider regarding rights relating to its contract, including cancellations, refunds or performance issues.
19. Privacy and Cookies
Your privacy is important to us.
Our collection and use of personal information is governed by our applicable Privacy Policy.
The Service may also use cookies and similar technologies. Further information should be provided through our applicable cookie notice or consent mechanism.
Third-Party Providers may process your personal information independently when you visit their websites or use their services. Their own privacy policies will apply to that processing.
You should review the relevant provider's privacy information before submitting personal information to it.
20. Third-Party Terms
Third-Party Providers may impose their own terms and conditions.
By proceeding to a Third-Party Provider's service, you are responsible for reviewing and agreeing to any applicable terms.
Destination Hub cannot alter or waive the terms imposed by an independent provider.

Please provide enough information for us to understand and investigate your complaint.
If your complaint concerns a booking, purchase, claim, event, restaurant, transport service or another product or service supplied by a Third-Party Provider, you may need to contact that provider directly.
We will try to identify the appropriate route where reasonably possible, but we cannot determine disputes on behalf of independent providers.
22. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes to the Service, our commercial relationships, applicable law or regulatory requirements.
The latest version will be made available through the Local Guide and will show the date on which it was last updated.
Where a change materially affects users and it is appropriate to do so, we may provide additional notice.
Your continued use of the Service after updated Terms take effect will be governed by the updated Terms, subject to any rights you have under applicable law.
23. Transfer of Our Rights
We may transfer our rights and obligations under these Terms to another organisation, for example as part of a corporate restructuring or transfer of our business.
Where applicable law requires us to notify you or obtain your consent, we will do so.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

Except where these Terms expressly provide otherwise, no person other than you and Destination Hub Limited has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
27. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from or relating to them are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom, you may also benefit from mandatory protections available under the laws applicable where you live.
If you are a consumer, you may bring legal proceedings in the courts available to you under applicable law.
If you are using the Service for business purposes, the courts of England and Wales shall have exclusive jurisdiction over disputes arising from or relating to these Terms.
